While we provide our expertise and services to the best of our ability, the responsibility to ensure that the proposed modifications comply with all relevant regulations lies with you, the vehicle owner.

Any requests for tuning are understood to be intended for off-road or race applications only. These modifications may not be suitable or legal for use on public roads. It is your sole responsibility to ensure that your vehicle remains roadworthy and complies with all transport and main roads laws if you intend to use it on public roads. This includes but is not limited to, ensuring compliance with emissions standards, safety requirements, and other regulatory standards applicable in your jurisdiction.

SC Diesel Tuning cannot be held responsible for any legal repercussions, penalties, or issues arising from non-compliant modifications. By proceeding with our services, you acknowledge and accept full responsibility for verifying that your vehicle meets all necessary legal standards and requirements for its intended use.

Liability Waiver:

SC Diesel Tuning, along with its dedicated employees and subcontractors, cannot be held liable for any loss, damage, injury, or unfortunate circumstances resulting from the modifications performed on your vehicle. This includes, but is not limited to, mechanical failure, electrical issues, or any adverse effects on vehicle performance or safety.

By engaging our services, you acknowledge that modifications can inherently carry risks, including potential incompatibility with existing vehicle systems or components, and the possibility of unforeseen consequences despite our best efforts and expertise. You understand and accept that any changes from the stock/factory settings can impact your vehicle’s reliability and durability.

Furthermore, SC Diesel Tuning is not responsible for any additional costs incurred due to these modifications, such as towing, rental vehicles, lost time, or any other expenses arising from a vehicle breakdown or failure post-modification.

We strongly advise you to carefully consider these factors and accept this understanding before proceeding with any modifications. By agreeing to these terms, you fully release SC Diesel Tuning, its employees, and subcontractors from any liability related to the modification process and its outcomes.

Authorization and Responsibility:

By engaging our services, you grant SC Diesel Tuning explicit authorization to carry out the modifications agreed upon. This authorization includes, but is not limited to, the disassembly, modification, replacement, or enhancement of vehicle parts and systems as discussed and documented in our agreement. You acknowledge that these modifications are performed based on your specific requests and preferences.

It’s important to recognize that such modifications may void the manufacturer’s warranty. Modifying your vehicle can alter its original specifications and performance characteristics, which might lead to the manufacturer declining warranty claims for affected parts or systems. As the vehicle owner, you assume full responsibility for this potential outcome and any associated costs.

You also understand that certain modifications may have legal and regulatory implications. It is your responsibility to ensure that the modifications comply with all relevant local, state, and federal laws and regulations. SC Diesel Tuning will not be liable for any legal issues arising from non-compliance with these laws.

Furthermore, you accept that modifications can impact the vehicle’s insurance coverage. It is advised to consult with your insurance provider to understand how the modifications might affect your policy and to make any necessary adjustments.

By proceeding with our services, you fully understand and accept the risks, responsibilities, and potential consequences associated with vehicle modifications. You agree to hold SC Diesel Tuning harmless from any claims, losses, or damages that may arise from the modifications performed.

Payment Terms:

At SC Diesel Tuning, we prioritize transparency and clarity in all our transactions. Payment is due upon completion of works, and we operate on a Cash on Delivery (COD) basis. We understand that sometimes parts may be required for the completion of your vehicle’s modifications. In such cases, we may request a deposit to cover the costs of these parts.

It is essential to note that failure to make payment within a suitable timeframe may result in storage costs being incurred. If payment is not received promptly, storage costs will be charged at a rate of $35 per day for up to 30 days. Should payment remain outstanding after 30 days, the storage rate will increase to $55 per day for an additional 60 days, up to a total of 90 days.

After 90 days of non-payment, SC Diesel Tuning reserves the right to take ownership of the vehicle and dispose of it to satisfy the debt owed. We strive to avoid such circumstances and encourage open communication regarding payment arrangements to prevent any inconvenience or additional costs.

Please be aware that while we accept card payments for your convenience, a small fee of 2.2% applies for Visa or Mastercard transactions and 2.8% for American Express transactions. By engaging our services, you agree to these payment terms and acknowledge your responsibility for timely payment to avoid any additional charges or consequences.

Vehicle Operation:

Rest assured, any operation of your vehicle within our premises, including testing and inspection purposes, will be conducted with the utmost care and professionalism by our trained staff. However, there are instances where it may be necessary to operate your vehicle on public roads for testing purposes to ensure the modifications function correctly under real-world conditions.

For us to conduct road testing, it is imperative that the vehicle owner maintains valid insurance coverage that permits our staff to operate the vehicle. Proof of this insurance must be provided before any road testing can commence. This insurance must cover any potential damages or liabilities that may occur during the road test.

In the unfortunate event that an accident occurs during a road test and our staff are found to be at fault, SC Diesel Tuning will cover the excess of your insurance policy only. We will not be liable for any additional costs, damages, or claims beyond the excess amount.

No road testing will be performed unless proof of valid insurance coverage is provided by the vehicle owner. By agreeing to these terms, you acknowledge and accept the necessity of providing this proof and the conditions under which road testing will be conducted.

Workshop Liability:

While your vehicle is under our care, we take all necessary precautions to ensure its safety and security. This includes implementing rigorous safety protocols, maintaining a secure environment, and using professional-grade tools and equipment. However, despite our best efforts, there are certain risks that are beyond our control.

SC Diesel Tuning cannot be held responsible for any loss, damage, or theft of the vehicle or its parts due to unforeseen circumstances such as natural disasters, fire, theft, vandalism, or any other incidents beyond our reasonable control. We advise that you remove any valuable personal items from the vehicle before bringing it to our workshop, as we are not liable for the loss or damage of personal belongings left inside the vehicle.

By agreeing to these terms, you acknowledge that while we will exercise due diligence in the care of your vehicle, you understand and accept the inherent risks associated with leaving your vehicle in our workshop.

Equipment Usage:

Our workshop is equipped with state-of-the-art tools and machinery to facilitate the modification process. Please be aware that any damage incurred during the usage of these tools is not attributable to SC Diesel Tuning. Furthermore, if any damage to the equipment occurs due to a failure related to your vehicle, you, as the vehicle owner, will be responsible for any repair or cleanup costs incurred.

Dynotech Dynamometer:

During the utilization of our Dynotech chassis/hub dynamometer, vehicles are subjected to high levels of stress, including high speeds and high RPMs, to ensure accurate testing and tuning. While this process is essential for optimal performance tuning, it inherently carries certain risks. These risks may include, but are not limited to, differential failure, tire blowouts, or other mechanical failures.

SC Diesel Tuning is not responsible for any damage or failure that occurs to your vehicle because of these testing conditions. By agreeing to these terms, you acknowledge and accept the potential risks associated with dynamometer testing. Additionally, should any such failures occur that result in damage to our equipment or necessitate cleanup, you, as the vehicle owner, will be responsible for covering the costs of repairs or cleanup required.

We appreciate your understanding and cooperation in acknowledging these risks and responsibilities associated with dynamometer testing.

Fuelling

At SC Diesel Tuning, we strive to ensure that your tuning experience is smooth and efficient. To facilitate this, we have implemented the following re-fueling policy:

1. Fuel Level Requirement:
   • Unless advised otherwise by our staff, all vehicles booked in for tuning must have a minimum of 50% fuel in the tank upon arrival. This ensures that there is an adequate fuel supply for the duration of the tuning process.
2. Charges for Re-Fueling:
   • If re-fueling is required during the tuning process due to low fuel levels, a charge will be applied to cover the cost of fuel.
     The re-fueling charges are as follows:
     • $3.50 per liter for 98RON petroleum.
     • $3.00 per liter for Diesel.

We kindly ask for your cooperation in adhering to these guidelines to avoid any delays or interruptions during the tuning session.
