Sunshine Coast Diesel Tuning – Disclaimer & Terms of Service

Thank you for choosing Sunshine Coast Diesel Tuning (“we”, “us”, “our”). By booking, authorising, or using our services, you (“you”, “customer”, “vehicle owner”) agree to the following terms.

  1. Definitions
  • Services include (but are not limited to): ECU/TCU tuning, dyno testing, diagnostics, road testing, software updates, security/ECU unlock processes, parts supply/fitment, and general workshop labour.
  • Prohibited Road Use Modifications means any modification that may make the vehicle non-compliant for public road use, including (without limitation) emissions system removal/defeat (e.g. DPF/EGR/AdBlue/SCR delete or defeat), and modifications outside legal limits (e.g. lift height, tyres, track width, noise/emissions compliance, lighting, etc.).

  1. Legal Use, Compliance & Off-Road Use Only

Some Services and modifications we provide are supplied strictly for off-road / closed-course / race use only. You acknowledge and agree that:

  • Prohibited Road Use Modifications (including emissions system removal/defeat) may be illegal for use on public roads and may render the vehicle unroadworthy/defective.
  • You are solely responsible for ensuring the vehicle is legal, roadworthy, and compliant with all applicable laws (including ADR and state/territory requirements) if used on public roads.
  • We do not represent or guarantee that any modified vehicle is compliant, roadworthy, registrable, or insurable.
  • If you choose to operate a non-compliant or defective vehicle on public roads, all risk and responsibility remains with you, including fines, penalties, defect notices, impoundment, insurance issues, and any related consequences.

  1. Your Responsibilities (Vehicle Condition, Disclosure & Maintenance)

Before we commence work, you confirm the vehicle is in a suitable condition for the requested Services and you have disclosed any known issues, including (without limitation): warning lights, limp mode, overheating, transmission slip/harsh shifts, boost/fuel faults, injector/pump issues, electrical faults, prior tuning, or modifications that may affect reliability.

  • You are responsible for appropriate servicing/maintenance and suitable consumables (oil, coolant, tyres, brakes, etc.).
  • If we identify safety concerns or mechanical risk, we may refuse to proceed, pause work, or recommend further diagnostics/repairs.
  • Time spent on diagnostics or work already performed is billable at our standard rates.

  1. No Guaranteed Results (Performance, Economy & Reliability)
  • Power/torque gains, drivability improvements, and fuel economy outcomes vary by vehicle condition, fuel quality, environment, and hardware setup.
  • We do not guarantee specific performance figures, fuel economy improvements, or outcomes.
  • Dyno results can vary due to heat, tyres, strapping, drivetrain losses, and test conditions.

  1. Risk Acknowledgement

Modifying and tuning vehicles carries inherent risk. Failures can occur during or after modification, including (without limitation): engine/drivetrain failure, turbo failure, injector/pump failure, cooling issues, sensor failures, and transmission/transfer/driveline failures.

To the maximum extent permitted by law, we are not responsible for failures or losses caused by pre-existing conditions, poor maintenance, unsuitable/defective parts, fuel contamination/quality, improper prior work, or the general risks associated with modified vehicles, except to the extent caused by our negligence or required by law.

  1. Australian Consumer Law (ACL)

Nothing in these terms excludes, restricts, or modifies any rights or remedies you may have under the Australian Consumer Law or other laws that cannot be excluded.

To the maximum extent permitted by law, our liability for any claim connected with the Services is limited (at our option) to:

  • re-supplying the Services; or
  • paying the cost of having the Services re-supplied.

To the maximum extent permitted by law, we are not liable for indirect or consequential loss (including loss of profit, loss of use, business interruption, or downtime).

  1. Quotes, Estimates, Variations & Authority to Proceed
  • Quotes are estimates unless stated otherwise in writing.
  • If additional work is required (e.g. seized bolts, hidden faults, additional diagnostics), we will seek approval where practical.
  • You authorise us to make reasonable minor adjustments necessary to complete the agreed work safely (e.g. consumables or minor fittings), charged at standard rates.

  1. Bookings, Deposits, Cancellations & No-Shows
  • Deposits may be required for bookings, parts ordering, or third-party services (including security unlock/shipping).
  • Cancellation fees apply:
    • $200 cancellation fee for dyno bookings.
    • $100 cancellation fee for mechanical works.
  • Deposits are non-refundable where we have ordered parts, booked dyno time, commenced diagnostics/labour, or incurred third-party costs.
  • If you fail to attend a scheduled booking (“no-show”), we may charge the relevant cancellation fee and/or retain any deposit to cover allocated time and costs incurred.

  1. Payment Terms, Storage Fees, Lien & Uncollected Vehicles
  • Payment is due in full on completion unless otherwise agreed in writing.
  • We may retain possession of the vehicle and/or parts until all amounts owing are paid (including labour, parts, third-party/sublet services, authorised fees, and storage charges).
  • If the vehicle is not collected within 48 hours of us notifying you that it is ready for collection, storage fees may apply, unless we have made alternative arrangements with you in writing prior to booking:
    • $35/day for the first 30 days, then
    • $55/day thereafter.
  • If the vehicle remains uncollected, we may dispose of or sell the vehicle strictly in accordance with applicable Queensland law (including required notices and timeframes), and apply proceeds to amounts owing and reasonable costs of storage, sale, and recovery. Any surplus will be handled as required by law.

  1. Card Payments & Surcharges

If you pay by card, a card payment surcharge may apply. Any surcharge will not exceed our cost of acceptance for that payment type and may change from time to time.

  1. Road Testing
  • You authorise us to road test the vehicle where reasonably required for diagnosis, verification, or quality control.
  • Road testing may be refused if we consider the vehicle unsafe, unregistered, uninsured, defective, or non-compliant.
  • If the vehicle is modified in a way that makes it unroadworthy/non-compliant, you acknowledge it may only be tested off-road/private property (where possible) or not at all.

  1. Workshop Security, Personal Property & Force Majeure
  • Please remove valuables before dropping off your vehicle. We are not responsible for loss of personal items left in the vehicle.
  • We take reasonable care of vehicles on site; however, to the maximum extent permitted by law, we are not liable for loss or damage caused by events outside our control (e.g. fire, flood, storm, theft by third parties, vandalism), except to the extent caused by our negligence or required by law.

  1. Customer-Supplied Parts & Third-Party Services
  • We provide no warranty on customer-supplied parts.
  • We are not responsible for defects, failures, delays, or issues caused by third-party products/services.
  • Any additional labour required due to unsuitable parts, incorrect fitment, or incompatibility is billable.

  1. Workshop Equipment, Clean-Up & Damage
  • If your vehicle leaks fluids, ejects debris, or causes contamination that requires clean-up or disposal, you agree to pay reasonable clean-up and downtime costs, except where caused by our negligence.
  • If your vehicle causes damage to workshop tools/equipment due to vehicle condition or undisclosed issues, you may be responsible for reasonable repair/cleanup costs, except where caused by our negligence.

  1. Dyno Testing (Dynamometer Use)

Dyno testing subjects vehicles to high load. While necessary for tuning and verification, failures can occur (e.g. tyre issues, driveline failures, overheating, mechanical/electrical faults). You acknowledge these risks and authorise us to perform dyno testing where required.

  1. Fuel Policy

Vehicles must arrive with at least 50% fuel unless otherwise agreed. If refuelling is required, fuel and handling charges apply at our posted rates (which may be updated from time to time).

  1. Software, Files, Data & Intellectual Property
  • Any tuning file, calibration, map, method, or workflow we create or supply remains our intellectual property.
  • You receive a licence to use the supplied calibration only for the specific vehicle/ECU/TCU it was supplied for.
  • Copying, sharing, reselling, reverse engineering, or applying the calibration to another vehicle is prohibited.
  • We may store logs, calibration notes, and version history for support and quality control.

  1. Media Consent (Optional)

We may take photos/videos/dyno graphs for records and marketing. If you do not consent to marketing use, you must notify us in writing prior to your booking.

  1. Disputes & Conduct
  • Please raise any concerns promptly and allow a reasonable opportunity to inspect and address issues where appropriate.
  • Abusive, threatening, or unsafe conduct may result in immediate cessation of work. Costs incurred to that point remain payable.

  1. Governing Law

These terms are governed by the laws of Queensland, Australia. Any disputes will be dealt with in Queensland forums/courts as applicable.

  1. Severability

If any clause is found to be invalid or unenforceable, the remaining clauses remain in full force and effect.
